Rent Arrears
If you don't pay your rent, you could be at risk of losing your home. So keeping up with your rent payments should be your top financial priority.
Many homeowners have problems paying their rent payments. It can result from loosing their job, splitting up with their partner or experiencing unexpected events and expenses.
Rent Arrears – What does it mean?
If you're struggling to pay your rent, you need to act quickly, even if you think that your problems are only going to be temporary. If you don’t act quickly you will find that the landlor may obtain a Possession Order against you and you will be struggling to keep ownership of your home.
In many cases repossession can be stopped or delayed, even after a court order has been made. This can be either through negotiation or Court proceedings. If you are in doubt about what you should do, contact us.
Whatever the situation it is important to come to an agreement with your landlord. If you cannot reach an agreement it may be necessary to go to Court where a Judge, after hearing both sides’ positions, is at liberty to shape an agreement between you. However, if the Judge feels that your proposal has no chance of succeeding, he is unlikely to suspend an eviction warrant.
A Possession Order will usually be followed in a fairly short period by a warrant for your eviction from your home. Once an eviction has taken place there is, realistically, very little chance of saving your home.
Dealing with rent arrears – the options available
If your are arrears with your rent, if saving the place you live is your aim and ifyou have a realistic long term chance of doing it, at Ashley Longmann Associates we will work with you to find the most appropriate way of dealing with your mortgage arrears and saving your home. There are a variety of options, and we may need to use more than one option if we are to be successful; it will depend upon your circumstances.
We will aim to come to an agreement with your landlord over your rent arrears. If this cannot be reached it may be necessary to go to Court where, in most cases, we will ensure that your case is fully represented to the Judge.
We may broker an agreement with your landlord where they agree not to proceed with repossession if you agree to pay the rent in full each month plus an agreed amount towards the arrears. Whatever your financial situation, you should always try to pay as much as you can towards the arrears.
We will always seek to reduce the financial pressure up you. By reducing the pressure to make repayments on other, unsecured debts, it will leave you better able to afford your rent and leave sufficient monies to repay your mortgage arrears.
You may have the opportunity to increase your income which will make your rent more affordable.
Less favourable options
You may decide to hand back the keys of your home to your landlord. This is called voluntary repossession.
